The initiative seeks to address what ministers described as a loophole in the application of the UK’s online safety regime to AI chatbot services. While the Online Safety Act 2023 established new obligations for technology platforms to protect children from harmful content, questions have arisen about how those duties apply to standalone AI systems that generate responses in real time rather than hosting user-posted material.

 

Officials said AI chatbot providers operating in the UK will be expected to comply with child safety duties, including implementing age-appropriate design and risk mitigation measures. The government’s position is that services likely to be accessed by children must take proportionate steps to prevent exposure to harmful or age-inappropriate content, regardless of whether the material is user-generated or produced by artificial intelligence systems.

 

Ministers indicated that regulatory clarity would be provided to ensure that AI services fall squarely within the scope of the law where relevant. In addition to clarifying the application of existing law to AI chatbots, ministers said they are examining whether further limits on social media access for users under 16 should be introduced. The review forms part of a broader strategy to reduce exposure to harmful online material and excessive screen time among minors.

 

Current UK rules do not impose a blanket ban on social media use by under-16s, though platforms must comply with child safety obligations under the Online Safety Act and adhere to the Children’s Code, formally known as the Age Appropriate Design Code, enforced by the Information Commissioner’s Office. The government is assessing whether additional statutory measures are warranted.

 

Officials have cited growing public concern over the impact of online platforms on children’s mental health and wellbeing. While no final decision has been announced, the government confirmed that options under consideration include stronger age verification requirements and potential limits tied to specific age thresholds. Any such steps would require legislative or regulatory action consistent with existing legal frameworks.

 

Broader Child Protection Strategy

 

The announcement aligns with the UK’s broader digital safety agenda, which has intensified since the passage of the Online Safety Act. The legislation was designed to impose a duty of care on technology companies, compelling them to address illegal content and protect children from harmful material such as cyberbullying, self-harm content and pornography.

 

By explicitly addressing AI chatbots, the government is responding to technological developments that have evolved since the drafting of earlier digital safety rules. Generative AI systems can produce text and other media outputs on demand, creating novel moderation challenges. Ministers said regulatory clarity is necessary to ensure that child protection standards keep pace with innovation.

 

The initiative also reflects international debates about how to regulate artificial intelligence in consumer-facing applications. Several jurisdictions are examining safeguards for minors in digital environments, particularly as AI tools become integrated into messaging platforms, search engines and educational software. The UK government’s approach positions AI chatbot oversight within its existing online safety architecture rather than creating a separate regulatory regime.

 

The Department for Science, Innovation and Technology stated that the objective is to ensure that children are afforded the same level of protection when interacting with AI systems as they are when using traditional social media or content-sharing platforms.
